1. Acceptance of Terms

Welcome to NBMMaths Grade 12 Study Guide App and Grade 10 - 12 Mathematics Website ("the Service"), operated by NBMDS Pty Ltd ("we," "us," or "our"). By accessing or using our mobile application, website (nbmmaths.co.za), or any related services, you agree to be bound by these Terms of Use ("Terms").

If you do not agree to these Terms, you must not use our Service.

These Terms apply to:

• Use of the NBM Maths Grade 12 Study Guide mobile application
• Access to nbmmaths.co.za website and all subdomains
• All study materials, videos, and resources provided
• Assessment marking services
• Video request services
• Any future services we may offer

2. Description of Services

NBM Maths provides educational content and services for Grade 12 Mathematics learners, aligned with the South African CAPS curriculum. Our services include:

2.1 Core Services (Included in R499 Subscription of Grade 12 Study Guide App)

• PDF Study Guides: 15+ comprehensive study documents covering all Grade 12 topics
• Video Lessons: 20+ hours of step-by-step video tutorials and solutions
• Grade 11 Revision Materials: Bonus content for foundational review
• External Resources: Curated links to 100+ additional learning materials
• Mobile Application: Android app for convenient learning

2.2 Additional Services (Separate Fees)

• Assessment Marking Service: Professional marking of practice tests (R100 per 50-mark assessment)

2.3 Service Availability

We strive to provide uninterrupted access to our Service, but we do not guarantee that the Service will be available at all times. We may suspend or restrict access for maintenance, updates, or technical issues without liability.

3. Registration and Account

3.1 Registration Process

To access our Grade 12 Study Guide APP Service, you must:

1. Pay the registration fee of R499 via bank transfer to our FNB account
2. Submit proof of payment via WhatsApp to +27 77 247 0414
3. Receive a unique licence / promo code via email within 24 hours
4. Register at nbmmaths.co.za/grade12_registration/ using your licence / promo code
5. Create a secure password for your account
6. Download and install the mobile application

3.2 Account Information

When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3.3 Account Restrictions

• One account per registration code
• Personal use only - no sharing of login credentials
• You may log in on multiple devices, 2, but not simultaneously share access
• Sharing your account with others may result in immediate termination

4. Payment Terms

4.1 Subscription Fee

• Amount: R499.00 (South African Rand)
• Duration: 12 months (1 year) from date of registration
• Payment Method: Bank transfer (EFT) to FNB account
• Processing Time: Promo codes issued within 24 hours of payment verification

4.2 Banking Details

• Reference: Your cellphone number or email address

4.3 Refund Policy

Due to the digital nature of our Service, all sales are final.

Refunds are not provided once:

• Your promo code has been issued
• Your account has been registered
• You have accessed any study materials or videos

Exceptions: Refunds may be considered in the following cases only:

• Technical issues that prevent access for more than 7 consecutive days (after we have attempted to resolve the issue)
• Duplicate payments made in error (within 48 hours of payment)
• Promo code not delivered within 48 hours and no response to inquiries

4.4 Assessment Marking Service Fees

• Cost: R100 per 50-mark assessment
• Payment: Required before marking begins
• Delivery: Within 7 days of submission
• Refunds: Not provided once work has commenced

4.5 Price Changes

We reserve the right to change our pricing at any time. Price changes will not affect existing subscriptions but will apply to new registrations or renewals.

5. Intellectual Property Rights

5.1 Ownership

All content provided through our Service, including but not limited to:

• PDF study guides
• Video lessons
• Practice exercises and solutions
• Text, graphics, images, logos
• Software code and mobile application
• Website design and layout

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for personal, educational purposes only
• Download PDF materials for offline study on your personal devices
• View video content via streaming within the application

5.3 Restrictions

You may NOT:

• Copy, reproduce, or distribute our materials to others
• Share, upload, or publish our content on other websites or platforms
• Remove watermarks or identifying information from materials
• Modify, adapt, or create derivative works
• Use content for commercial purposes
• Reverse engineer, decompile, or disassemble the mobile application
• Extract or scrape content using automated tools

5.4 Trademarks

"NBM MATHS," "NBMMATHS," and related logos are trademarks of NBMDS Pty Ltd. You may not use these marks without our prior written permission.

6. User Responsibilities

6.1 Appropriate Use

You agree to use our Service:

• Only for lawful educational purposes
• In accordance with these Terms and all applicable laws
• In a manner that does not harm us or others
• Respectfully when interacting with our support team

6.2 Technical Requirements

You are responsible for:

• Obtaining compatible devices (Android 5.0+ for mobile app)
• Maintaining internet connectivity for online features
• Ensuring adequate storage space for downloaded materials
• Keeping your devices secure and virus-free
• Backing up any work or notes you create

6.3 Academic Integrity

Our materials are study aids intended to help you learn. You agree to:

• Use materials to understand concepts, not just copy answers
• Complete your own school assignments and exams
• Not submit our materials as your own work
• Follow your school's academic integrity policies

7. Prohibited Uses

You expressly agree NOT to:

• Share your login credentials with others
• Distribute, sell, or share downloaded materials
• Upload our content to file-sharing sites, social media, or other platforms
• Screenshot or record videos for distribution
• Remove or alter watermarks or copyright notices

7.2 Technical Violations

• Attempt to circumvent security measures
• Use bots, scrapers, or automated tools to access content
• Interfere with the proper functioning of the Service
• Introduce viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems

7.3 Commercial Violations

• Resell, license, or commercialize our content
• Use content to create competing products or services
• Frame or link to our content inappropriately
• Use our Service to provide tutoring services for profit using our materials

7.4 Abuse and Harassment

• Harass, threaten, or abuse our support staff
• Submit false information or fraudulent payment claims
• Make excessive or unreasonable support requests

8. Content Protection

All PDF materials and some video content include digital watermarks containing your account information. This helps us:

• Track unauthorized distribution

8.2 Anti-Piracy Measures

We actively monitor for unauthorized distribution of our content. If we discover materials traced to your account being shared illegally:

• Your account will be immediately suspended or terminated
• No refund will be provided

8.3 Device Limitations

While you may log in from multiple devices, simultaneous access from multiple locations may be flagged as account sharing and result in account review or suspension.

9. Assessment Marking Service

9.1 Service Description

Our professional assessment marking service includes:

• Marking of your submitted test/assessment (up to 50 marks)
• Detailed memorandum with correct answers
• Personalized feedback on areas needing improvement
• Delivery within 7 days via email

9.2 Submission Requirements

To use this service:

• Submit clear scans or photos of your completed answer book
• Email to: gr12tests@nbmmaths.co.za
• Include your account number and payment confirmation
• Pay R100 fee before marking begins

9.3 Limitations

• Maximum 50 marks per assessment
• Only mathematics content aligned with Grade 12 CAPS
• Turnaround time: 7 business days (may be longer during exam periods)
• We reserve the right to refuse assessments that violate academic integrity

9.4 No Guarantee of Marks

This service provides feedback for learning purposes. We do not guarantee any specific marks or outcomes on your actual school assessments or exams.

10. Limitation of Liability

10.1 Educational Aid Only

Our Service is provided as an educational aid. We do not guarantee:

• Specific academic results or improvements
• Passing grades on exams or assessments
• Admission to universities or colleges
• That our content covers all possible exam questions

10.2 No Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy or completeness of content
• Uninterrupted or error-free operation
• Freedom from viruses or other harmful components

10.3 Limitation of Damages

To the maximum extent permitted by South African law, NBMDS Pty Ltd shall not be liable for:

10.5 Technical Issues

We are not liable for issues caused by:

• Your internet connection or device compatibility

11. Termination

11.1 Termination by You

You may stop using the Service at any time. However:

• No refunds are provided for unused time
• Your access will expire at the end of your subscription period

We reserve the right to suspend or terminate your account immediately, without notice or refund, if:

• You violate these Terms of Use
• You engage in fraudulent activity
• You share your account or distribute content illegally
• We suspect unauthorized access or security concerns
• You abuse or harass our support staff
• Required by law or regulatory authority

11.3 Effect of Termination

Upon termination:

• Your access to the Service will be immediately revoked
• You must cease using all materials and delete downloaded content
• Provisions regarding intellectual property, liability, and disputes survive termination

11.4 Account Expiration

Accounts expire 12 months after registration. To continue access:

• You must purchase a new subscription
• Renewal pricing may differ from original subscription price
• We will send reminder emails before expiration

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

12.2 Your Acceptance

15. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NBMDS Pty Ltd regarding use of the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account to anyone else. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

These Terms are provided in English. If translated, the English version prevails in case of any inconsistency or difference in interpretation.
